My name is Yolanda
Gammill. I’m a Deputy City Attorney in
the Civil Division of the City Attorney’s Office, representing City Attorney
Michael Aguirre.
I am here to notify you that,
under Section 40 of the San Diego City Charter, the City Attorney’s Office is
assuming the role of chief legal advisor to the San Diego City Employees
Retirement System. As indicated in the City
Attorney’s letter of December 15, legal counsel to the Retirement System is no
longer authorized to provide any legal advice to this Board and should report
to the City Attorney for further instruction.
We are making a record of
today’s meeting. Board members, who disregard the San Diego City Charter and
the Municipal Code, as indicated in the City Attorney’s letter of December 15,
will be held accountable under the law for their actions.
Furthermore, the Retirement
Board is also directed not to proceed with any decisions or convene any closed
door sessions to the extent that you are relying upon the advice of any counsel
other than the City Attorney’s Office.
